It is important to include the entire ecosystem in determining certainty, but you fail to include the only relevant party when upgrading consensus rules, the miners. From verifiable data, there is statistical certainty that the legacy chain will not exist post HF or at best has a remote probability of being usable post upgrade.
In-fact, implementing strong 2-way replay protection in the btc1 client would improve the statistical probability of the legacy chain surviving post upgrade and in contravention of the stated aims of the BTC1 WG.
